Your Right to Privacy - Our Promise of Security
Enliven Software understands the importance of keeping your personal information secure. We only collect information that we need to provide the Fidesic on-line payment services ("the Service")to you. This statement explains what information we collect, how we use it and how we keep it secure. Fidesic Corporation reserves the right to amend or change this Privacy Statement at any time; the latest revision date will be displayed with the Statement on the Fidesic web site. Please check the web site periodically and review any revisions. Your continued use of our web site after revisions are posted will be deemed to be your agreement to the changed terms. TRUSTe Certification Fidesic Corporation is a licensee of the TRUSTe Privacy Program. TRUSTe, an independent, non-profit organization, has a mission to build users' trust and confidence in the Internet by promoting the use of fair information practices. Frequently Asked Questions about Privacy

It is Fidesic's policy that we will not sell, trade or assign your Personally Identifiable Information to third parties, such as mailing houses or advertisers. Any information that we do need to share with our business partners is limited strictly to the information they need to process payment or other requests on our behalf. The information we collect is limited only to that information we need to run our service.

1. What information does Enliven collect from me and how does it use it?

Personally Identifiable Information. Enliven will collect the following information from you when you register for our services. To change your information at any time, simply go to the Profile page for your user account. To protect you and other Fidesic users from fraud, we require you to contact our Customer Support department to change certain information such as your business name. Your Name. We collect your name in order to identify you, to verify your ownership of your checking account, and to provide customer support to you. Email Address. We will use your email address as a unique account identifier for you. We will also use your email address to verify your identity when you register, to correspond with you and to respond to your questions. We may retain part or all of your email communications with us in our customer service database in order to fulfill your requests as quickly and effectively as possible. In the event that we make material changes to our policy regarding Personally Identifiable Information we will notify you via email, at which point you will have the option to opt out of the Service.

Security Information. Access PIN. You will create and provide us with a unique Access PIN. Your Access PIN, together with your name, will permit you to access your personal account area. We encourage you to change your Access PIN frequently to safeguard your information. PIN Recovery Question and Answer. You will supply us with a question and answer, such as your mother's maiden name or your favorite color, to verify your identity if you forget your Access PIN. After answering your recovery question correctly, you will be allowed to create a new Access PIN. Mailing Address. We request your mailing address in order to verify your physical address and ownership of your checking account. Telephone Number. We request your telephone number in case we need to contact you directly regarding your account and to verify your identity.

Account Information. Fidesic will collect the following Account Information from you when you register for the Service and when you use the Services. You may change your Account Information on the Profile page for your account.

Checking Account Number. We require your checking account information to enable the withdrawal and deposit of funds using your account.

Credit Card Account Number, Expiration, Cardholder Name, and Billing Address. You need to supply the information above if you wish to use a credit card to make purchases. We may also require additional verification numbers from your card when you make a purchase. If you do supply a credit card we may, at our option use it as a secondary source of funds in the event your checking account does not have a sufficient balance to cover payments you have scheduled. Our Terms of Service Agreement specifies when your credit card will be used for that purpose.

Social Security Number or Tax Identification Number. You must provide your Social Security Number or Tax Identification Number in order to make payments with our service. We may use this information to validate your identity. We may share information with credit-reporting agencies about payments from your account that are rejected due to insufficient funds or other reasons; you have a right to add an explanation of these situations to your credit report.

Payee email addresses. We will collect the email addresses of people you will pay using the Service. This information is required to enable payments using the Service. Non-members will be asked to provide us with the information described in this section in order to use the Service and complete any transactions you have scheduled. They may elect not to provide this information, in which case the transaction(s) will be canceled.

Payor email addresses. We collect the email addresses of people who will pay you using the Service. This information is required to enable payment requests using the Service.

Automatically Collected Information. Enliven's server gathers traffic data about your use of the web site in the form of server logs. Our log files contain IP addresses and Enliven member IDs, which can be linked to user information. We do not sell these files to a third party, but we do use a third party, bound by a confidentiality agreement, to process the logs. We will only link personally identifiable information with IP addresses and site usage data when investigating fraudulent behavior or other uses of the site that violate our Terms of Service. In all other cases, we use aggregated log information to track which domains and geographic regions our members are logging in from, site navigation patterns, and to help diagnose problems with the Service.

2. How long does Enliven store my information?

As long as you maintain an account with Enliven, you will be able to obtain a record on-line showing your bill and payment history for the current and past calendar year. You may also request electronic copies of these records by contacting our Customer Support department. After we have verified your identity, we will forward copies of your records to you.

3. How does Enlivenprotect my information?

Encryption Technology. Any connections to the Enliven web site involving your Account Information or Personally Identifiable Information will be made through a secure connection that is validated by the unique Access PIN you establish at registration and your user name (email). All information transferred during every session, including your Personally Identifiable Information, your Account Information and your Access PIN will be encrypted using Secure Sockets Layer (SSL) encryption technology. In addition, sensitive information, such as your Access PIN, checking account number, and credit card information will be encrypted when stored in our databases. To ensure that your sessions are encrypted, look for the "https" in your browser's address bar before "Fidesic.com" or look for the browser's "secure site" icon during your session. If you do not see the "https" (be sure to look for the "s" following "http") or the secure server icon, log in again.

Furthermore, we're committed to deploying the best encryption technology available. We'll continue to upgrade our security as advances are made.

Internal Restrictions. Fidesic Corporation stores its production hardware in a secure, climate controlled collection facility with armed guards and video monitoring of locked racks to prevent unauthorized access to our servers.

We limit employee access to your Account Information. In accordance with our "need to know" policy, only employees and service partners with a valid business reason related to providing the Service will have access to your Account Information. No employees have access to your Access PIN. Only specifically authorized personnel have access to checking account and credit card information when needed to resolve transaction questions or problems. Sensitive data such as your Access PIN, PIN Recovery Answer, Social Security or Tax Identification Number, checking account Number and Credit Card Account Number are transferred and stored in our database in an encrypted format. We also train all our employees about the importance of confidentiality and our policies regarding privacy and security.

Your Access PIN. We recommend that you change your Access PIN every 60 days. As a security precaution, don't use an Access PIN that will be easy for someone to guess such as your name, your spouse's name, your social security number, your birth date or your street address. Do not disclose your Access PIN to anyone. Enliven will never contact you by phone or email to ask for your Access PIN. If you believe that somebody has learned your Access PIN, immediately go to the Profile page for your user account and change your Access PIN.

We recommend that you log off after every session. If, during the session you do not view a new page for 20 minutes, the site will log you off and you will need to re-enter your User ID and Access PIN. This automatic log off measure prevents unauthorized access to your account if you step away from your PC during a session. However, we strongly recommend that you log off any time that you leave your PC.

4. Does Enliven share my information with anyone else?

Enliven will share your Personally Identifiable Information with a limited number of service partners in order to provide the service to you. These parties include:

  • Our Originating Depository Financial Institutions (ODFI) in order to initiate transactions on our behalf.
  • Our acquiring bank to validate your physical address.
  • A credit-reporting agency to validate user information.
  • Outsourcing companies that perform functions on behalf of Enliven, such as the company that prints and mails our welcome letters to users.

When using the Service, the businesses or individuals that you pay and invoice will be sent email that includes your name and email address. When payment or request information is displayed on the web site, your city and state will also be displayed to these parties. If you sign up as a business, your address may be displayed if another member correctly identifies your name and zip code. This is to make it easier for other Fidesic members to pay you at the email address you have provided with Fidesic. If you sign up as an individual, your name may be provided to Fidesic members who have already provided your correct mailing address or email address. This is to make it easier for Fidesic members to confirm that they are paying the right person.

5. Will Enliven sell the information it collects from me?

Enliven will never sell, trade or assign your Personally Identifiable Information or Account Information to third parties, such as mailing houses, market research firms, or advertisers. We may aggregate the Personally Identifiable Information that we receive from all registered users of the Fidesic web site to prepare aggregate information about our users' demographics, interests and behavior. Fidesic Corporation may share this aggregated information with our affiliates, advertisers or marketing professionals. An example of the aggregated data that Fidesic Corporation might share is "4% of Fidesic users are from the state of California."

We do not merge or enhance any Personally Identifiable Information with any data collected from third party affiliates for the purpose of marketing products or services back to the user. No other organization collects Personally Identifiable Information at the Enliven site.

This aggregated user data is compiled and reported in the form of anonymous group statistical information.

6. How does Enliven communicate with me?

Enliven communicates with members in several ways:

Account Related Email. After you sign up for the service, Enliven sends you an activation email with a link to activate your account. Once you have clicked through this link and logged in, you will receive a welcome email, and an email you can forward to associates and friends which describes the benefits of the service.

In addition, Enliven will send you email alerts when you make changes to your account, such as your checking account or credit card number.

Payment Related Email. Enliven will send you email related to the status of your payments, including: confirmation of payments, alerts of payment failure, reversals and cancellation. We will also send email to your payees and payers when you send payments and invoices, and in the event of any payment failures, cancellations and reversals.

Promotional Email. Enliven will not send promotional emails to individuals unless the individual member asks to receive promotional emails. If you do wish to receive promotional emails, send an email request to support@fidesic.com asking that we include your email address when sending out email messages about offers or promotions that we believe may be of interest to you.

U.S. Mail. Enliven will send a letter via U.S. mail containing a 10-digit address verification code with instructions on how to enter the code on the Enliven web site and verify your address.

Enliven will also send you another 10-digit code via U.S. mail to verify your mailing address when you change your address information.

Telephone. Under certain circumstances, Customer Support may contact you regarding activity on your account, or to follow up on a Customer Service inquiry.

7. Can I stop Enliven from sending email offers and information?

Enliven will not send promotional emails to individuals unless the individual member asks to receive promotional emails. If you do wish to receive promotional emails, send an email request to support@fidesic.com asking that we include your email address when sending out email messages about offers or promotions that we believe may be of interest to you. Even if you do not choose not to receive offers and promotions, we will continue to email you about transactions made using your account, or changes to your account information.

8. Does Enliven use cookies?

Cookies are small files stored on your computer's hard disk. They help web sites "remember" information about you and your preferences. Enliven uses cookies for security purposes, and to analyze how users move around the Fidesic web site so that we can continually improve the efficiency and ease of use of the site. Our cookies do not contain any personally identifiable information, account information, or your PIN. However, since we do use them for security purposes, you must set your browser to allow cookies, or you will not be able to use the Enliven web site.

9. What about privacy on other sites on the World Wide Web?

The Fidesic web site may link to other sites on the World Wide Web. The Enliven web site at http://www.fidesic.com is not responsible for the privacy practices or the content of these other web sites. We recommend that you review the privacy policies of other sites on the World Wide Web that you visit.

10. Can I change my registration information?

You may change your Personally Identifiable Information and Account Information on the Profile page for your account. To protect you and other Enliven users from fraud, we require you to contact our Customer Support department to change certain information such as your business name.

11. What constitutes my acceptance of this privacy policy?

By registering on the Enliven web site and using the service, you expressly consent to the use and disclosure of information as described in this Privacy Policy. Enliven reserves the right to amend or change this Privacy Statement at any time; the latest revision date will be displayed with the Statement on the Enliven web site. If at any time we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users via email. Please check the web site periodically and review any revisions to the Privacy Statement; your continued use of our web site after revisions are posted will be deemed to be your agreement to the changed terms.
